This agreement is made by and between Individuals/Parents/Guardians and Chikku LLC, dba DcodeSTEM and Sohini Sangeet Academy, (hereinafter referred to as “Chikku LLC” or as “DcodeSTEM” or as DcodeSTEM/Sohini Sangeet Academy).

Both of parents/guardians (if minor)/individuals please sign "DcodeSTEM Agreement" Students will not be considered eligible for enrollment until this Agreement is executed by both parents/guardians who have physical and/or at legal custody of the said student in case minor or individual attending the class

• Parent/Individual acknowledges that in executing this Comprehensive DcodeSTEM & Sohini Sangeet Academy Agreement, the parent/individual is not relying upon any representation or statement made by DcodeSTEM/Sohini Sangeet Academy or its representatives or employees. This entire agreement between the parties supersedes all prior and contemporaneous oral or written statements.

• No amendments or modifications to this Comprehensive Agreement shall be of any force or effect unless contained in a subsequent writing signed by each party. No waiver of any provisions hereof shall constitute a waiver of any other provision, nor shall any waiver constitute a continuing waiver. Any waiver must be in writing and signed by the party making the waiver.

• Parent(s)/Individuals have the right to withdraw with a minimum 30 day written the notice and one week notice in case of summer and spring camp. Intention to withdraw must be made in writing to the administration and the business office. The date of withdrawal will be determined pursuant to the date of receipt of the intention to withdraw. All amounts, including fees owed through the determined withdrawal date, will be due and payable in full on the date of withdrawal.  Studio fees and registration fees, if any, are not refundable.

• Parent(s)/Individuals understand this requirement is effective immediately and applicable year-round including, but not limited to, summer sessions, spring camp and holidays.

• Parent(s)/Individuals understand that DcodeSTEM/Sohini Sangeet Academy in its absolute and sole discretion reserves the right to suspend and/or dismiss student(s), with or without notice, in circumstances where DcodeSTEM/Sohini Sangeet Academy determines that the welfare of the child in case of minor or individual in case on not a minor, the facility (including but not limited to the founders, employees, volunteers, or another student (s) and or their families) requires such dismissal.

• DcodeSTEM/Sohini Sangeet Academy reserves the right to suspend or permanently dismiss children or individuals at any time for unsatisfactory behavior. Unsatisfactory behavior is as determined by founders of Chikku LLC dba DcodeSTEM and/or Sohini Sangeet Academynew student reg

• Students must be escorted from DcodeSTEM facility after dismissal time, each session runs for approximately 30 minutes

• Sohini Sangeet Academy determines the curriculum, instructor(s), class assignment, and/or class composition, location of the class being conducted at its absolute and sole discretion.

• Parent(s)/Individuals jointly and individually agree and promise to pay Sohini Sangeet Academy the fees in advance for the 12 weeks of class. 

• Cost: Group Lessons 12 weeks $280 per student, $60 recital fees and $60 new student registration fee. Private classes $480 for 12 weeks, $60 recital fee and $60 new student registration fee

• This agreement is valid for the year 2020

• Two make-up classes are allowed during the 12 week period.

• If any legal action is brought to enforce or interpret the provisions of this agreement, the prevailing party will be entitled to reasonable attorney’s fees, which may be set by the court in the same action or in a separate action brought for that purpose, in addition to any other relief to which that prevailing party may be entitled.

• Parent(s) will inform DcodeSTEM/Sohini Sangeet Academy on a timely basis of any medical condition which may impact their performance (in case of minor child’s performance), safety or well-being, or that of other students, instructors, Staff or founders, faculty, staff and/or volunteers.

• This agreement must be completed by parent(s)/individuals and received by the DcodeSTEM/Sohini Sangeet Academy before any child or individual may begin classes at DcodeSTEM. All accounts must be current and in good standing before student(s) attend Sohini Sangeet Academy music class at DcodeSTEM location

• Parent(s) and student(s) agree to the following: 1) parent(s) and student(s) will abide by all points mentioned in this document titled “DcodeSTEM and Sohini Sangeet Academy comprehensive agreement document”

• Parent(s)/Individuals acknowledge they have thoroughly read this document and agree to abide by it

• Parent(s)Individuals acknowledge and agree that certain risks, known and unknown, are inherent in Student’s (s’) attendance at DcodeSTEM. Individuals, parent(s), on behalf of themselves, their children, heirs, representatives and estates, hereby release, discharge and hold harmless DcodeSTEM/Sohini Sangeet Academy, its founders, instructors, directors, agents, employees, volunteers, representatives and successors and/ or assigns (“Releasees”) from any and all claims and/or liability of any sort arising from acts or omissions in the performance of services under this Agreement and/or injury to Student(s) or Parent(s) arising from Student’s (s’) attendance at DcodeSTEM/Sohini Sangeet Academy music class and/or related activities (unless such acts, omissions or injury result directly from the willful misconduct of Releasees. ). Individuals, Parent(s), on behalf of themselves, their children, heirs, representatives and estates, hereby further release, discharge, and agree to defend, hold harmless and indemnify Releasees from claims, demands, charges, or causes of action of any sort arising from or connected to Student’s (s’) attendance at DcodeSTEM location and any related activities, including any claim of negligence on behalf of Releasees.

• If any provision or provisions of this Agreement shall be held to be invalid, illegal, unenforceable or unenforced or in conflict with the law of any jurisdiction, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.

• DcodeSTEM/Sohini Sangeet Academy does not discriminate on the basis of disability, race, color, national origin, ethnic origin, sex, or religion, or in the conduct of any of its programs.

• I hereby grant permission to member of DcodeSTEM/Sohini Sangeet Academy to take whatever steps may be necessary to obtain emergency medical care if warranted. These steps may include, but are not limited to, the following:

1. Attempt to contact a parent or guardian or emergency contact.

2.  In case of emergency DcodeSTEM/Sohini Sangeet Academy will do any or all of the following: (a) call another physician or paramedics, (b) call an ambulance, (c) have my child transported to Mercy Hospital of Folsom, or the closest available hospital in the company of a staff member.

3. I understand any expenses incurred under paragraph 2 (above) will be borne by the child's or individual(s) family.

4. I understand the DcodeSTEM/Sohini Sangeet Academy will not be responsible for anything that may happen as a result of false information given by parents/guardians or individual(s) at the time of enrollment.

• DcodeSTEM/Sohini Sangeet Academy will observe all holidays per the Folsom Unified School district for the year 2019-2020 and there will be no makeup classes for the holidays observed. There will be only 2 make-up classes for students going on vacation and for students not feeling well and cannot attend there will be an online or at location class (at DcodeStem location)  as determined by DcodeSTEM/Sohini Sangeet Academy

• By signing below, each signatory declares they have read, understood, and accepted this agreement.

• All provisions of this agreement, except ones preceded by “(Optional)”, are mandatory and will not be waived modified, or terminated, except by a Rider to the agreement signed by both Parent/Individual and DcodeSTEM and/or Sohini Sangeet Academy.

• By signing this Comprehensive Agreement, I/we represent and warrant for the benefit of DcodeSTEM/Sohini Sangeet Academy that I/we possess the legal authority to enroll the student(s) or ourselves named in this agreement and perform all of my/our obligations under this Agreement.
